Compulsory vaccination Measles Protection Act

In order to effectively protect children in nurseries and schools against measles, vaccination has been mandatory in Germany since 2020. The Measles Protection Act stipulates that children are not allowed to attend daycare or school without sufficient vaccination protection. Proof of measles vaccination must also be provided if the child is cared for by a childminder.

All children from the age of one must have the measles vaccinations recommended by the Standing Vaccination Commission when entering school or a daycare facility. Proof of measles vaccination must also generally be provided if the child is cared for by a childminder.

The same applies to people who work in community facilities (daycare centers) or medical facilities such as educators, teachers, daycare workers and medical staff (if these people were born after 1970).

Proof can be provided by the vaccination card, the yellow child examination booklet or - especially in the case of illness already suffered - a medical certificate. As a rule, proof must be provided to the management of the facility. It is also possible to provide confirmation from a previously visited facility that corresponding proof has already been provided there.

The same applies to staff in community facilities (daycare facilities) and medical facilities, such as hospitals or doctors' surgeries. This is already common practice in medical facilities. Here, too, staff must prove that they have been vaccinated, have already had the disease and are therefore immune.

If parents do not provide written proof of sufficient vaccination protection for their child when they are first admitted to a daycare centre, the daycare centre management must inform the responsible health authority in accordance with Section 12 KiBiz.

The law on modernizing the epidemiological surveillance of communicable diseases contains an amendment to Section 34 (10a) of the Infection Protection Act (IfSG). This paragraph previously stipulated that health authorities could invite parents to a vaccination consultation if they could not provide evidence of a vaccination consultation when they were first admitted to a childcare facility. In North Rhine-Westphalia, the obligation to provide proof of an age-appropriate preventive health check-up is based on Section 12 KiBiz.

This regulation has been amended to the extent that daycare center managers now inform the responsible public health department about the failure to provide proof of a vaccination consultation and transmit the personal data to the public health department. The health authority then decides whether the parents or guardians should be invited to a vaccination consultation.

"Upon initial admission to a child daycare facility, the legal guardians must provide written proof to the facility that a medical consultation regarding complete, age-appropriate vaccination protection for the child that is sufficient according to the recommendations of the Standing Vaccination Commission has taken place shortly before admission. If proof is not provided, the management of the childcare facility will notify the public health department in whose district the facility is located and provide the public health department with personal details. The public health department may invite the legal guardians to a consultation. Further state regulations remain unaffected."
